Leave for training courses attendance
Common regime
� Concept
Justified absence from work for a period higher than 60 days, in the interest of the public employee, for training courses attendance provided by educational or vocational training institutions
� Regime
Presuppositions
� 3 years of seniority of the public employee in the body or service
� The public employee shall not have benefitted from leave for the same purpose over the past 24 months
� In the case of holders of management positions, heads of multidisciplinary teams and public employees integrated in careers or categories of grade 3 of functional complexity, the grant of leave depends upon the inexistence of serious damage for the functioning of the service
Return
� In the return of the leave which has a duration lower than one year the public employee is entitled to fill a work post in the body or service
� In the case of the leave having a duration higher than one year the return to the service shall be dependent upon the existence of a work post predicted and not filled in the workforce list, however he/she may apply for open competition procedures
Early return
� The early return of the public employee depends upon the existence of a work post, however he/she may apply for open competition procedures
� Formalities
� Submission of a request within a minimum 90 days in advance
� Public employer�s authorization
� Effects
� Total loss of pay
� Determines the suspension of the contract with the Administration
� The leave period is not taken into account for seniority purposes
� Enjoyment of holidays to which he/she is entitled in the year of the move to the leave situation
� In the case of clear impossibility of enjoyment of holidays he/she is entitled to receive the compensation corresponding to the period of holidays not enjoyed and respective allowance
� In the year of termination of leave he/she is entitled to two days of holidays for each month of work
